Counsel-review draft. These pages describe how the campaign works and how we protect the operator and the advertising product. They are not a substitute for advice from a licensed lawyer in your jurisdiction. Last updated: August 28, 2026 1. What this site is Tattoo My Ass (“Site”, “Campaign”, “we”, “operator”) is an advertising campaign with a public leaderboard. When you pay and that payment is verified, you buy advertising exposure on this website. The advertiser with the highest total of eligible verified USD at campaign close may also receive the Tattoo Prize — only if the Tattoo Prize Rules and the tattoo reserve are satisfied. This is NOT gambling, betting, a raffle, a lottery, a sweepstakes, or a wager. You are buying advertising. The Tattoo Prize is an extra promotional benefit, not a payout for a bet. Being outspent does not entitle you to a refund of advertising you already bought. 2. Who may participate You must be at least 18 years old, or an authorized representative of a company/organization that can legally buy advertising. You confirm you have the rights to every name, logo, tagline, URL, and design you submit. You agree to indemnify the operator against claims arising from branding or designs you submitted without rights. 3. What you buy / what you do not buy YOU BUY (when payment is verified): • A public leaderboard listing for the campaign • Display name, approved logo (or placeholder), website link, tagline • Exposure for the remaining live campaign period • A listing on the permanent archive after close YOU DO NOT BUY: • A locked #1 rank • A guaranteed tattoo • The right to force a refused design • A refund because someone spent more • Exclusive advertising, impressions guarantees, or virality promises • Any right over the operator’s body beyond the conditional Tattoo Prize rules 4. Rankings Only eligible verified USD counts. Failed, cancelled, refunded, disputed, charged-back, fraudulent, or invalidated payments do not count. Pending and processing payments do not count. Manual/invoice payments do not count until an administrator verifies receipt. If a counted payment later becomes ineligible, the leaderboard is recalculated immediately. The operator’s records are the source of truth for rankings. 5. Branding approval The operator may refuse, hide, delay, or remove branding that violates the Acceptable Content Policy or creates legal, brand, or safety risk. A rejected logo does not cancel a legitimate advertising purchase by itself. A neutral placeholder may be shown until approval. Payment does not create a right to display refused content. 6. Operator rights The operator may, acting reasonably: • Pause or close contributions • Extend the campaign under anti-sniping rules • Refuse or terminate service for fraud, abuse, chargeback risk, or legal risk • Recalculate rankings after payment status changes • Correct obvious errors • Change payment providers without changing what you are buying (advertising ranked by verified spend) 7. No performance guarantees We do not guarantee traffic, impressions, press coverage, social virality, sales, or any specific marketing outcome. You are buying placement on this Site under these Terms. 8. Liability limit To the maximum extent allowed by law, the operator’s total liability to you for claims related to a contribution is limited to the amount of that verified contribution actually received and retained by the operator (after refunds/chargebacks). We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, even if advised of the possibility. Nothing here excludes liability that cannot be limited by law. 9. Publicity (winner / campaign) If you win or appear on the board, you grant the operator a worldwide, royalty-free license to use your approved display name, logo, tagline, website, rank, and contribution totals in connection with the Campaign, archive, press, and social posts. If the Tattoo Prize is performed, you also grant the operator the right to publish appointment photos, the finished tattoo photo, and behind-the-scenes video that show your approved design on the operator’s body, for documenting and promoting the Campaign. 10. Language, law, disputes These Terms are in English. If translated, the English version controls if there is a conflict. The Campaign is operated by an individual operator. Governing law and venue will be confirmed with counsel before launch (operator currently operates from Argentina; payment processors such as PayPal may apply their own rules). Before filing a formal claim, you agree to contact the operator in writing and allow 30 days to try to resolve the issue in good faith. 11. Changes We may update these Terms. The “Last updated” date will change. Continued use after an update means you accept the revised Terms for new activity. Material changes may also be flagged on the Site. 12. Entire agreement These Terms, plus the Advertising Purchase Terms, Refund Policy, Tattoo Prize Rules, Acceptable Content Policy, Payment Terms, Privacy Policy, Cookie Policy, and Ranking Rules, form the agreement for the Campaign. If one part is unenforceable, the rest stays in force.
